Where a Designated Premises Supervisor (DPS) leaves the business, changing the DPS named on the Premises Licence is a critical requirement to ensure the lawful continuation of alcohol sales.

​

Our DPS Variation Service supports clients with replacing the nominated DPS on their Premises Licence, ensuring the application is prepared and submitted correctly and without delay.

A new DPS must hold a valid Personal Licence to be nominated. This is a statutory requirement.

​

Under the Licensing Act 2003, it is a mandatory condition attached to every Premises Licence in England and Wales that no sale of alcohol may take place unless a Designated Premises Supervisor is specified. Selling alcohol without a DPS in place is unlawful.

If a DPS has left employment or has not yet been appointed, any sale of alcohol would constitute an unauthorised licensable activity, which may result in:

​

  • An unlimited fine

  • Up to six months’ imprisonment

  • A review of the Premises Licence

​

Where a suitable Personal Licence holder is available, a DPS variation can be submitted with a request for immediate effect, allowing the change to take effect on the same day the application is lodged and preventing disruption to alcohol sales.
