Licensing Sub-Committee Hearing Representation

Where a Premises Licence application or variation attracts representations (objections) that cannot be resolved, the matter will be determined at a Licensing Sub-Committee hearing convened by the Licensing Authority.

​

Our experienced Licensing Consultants provide professional representation at these hearings, acting on behalf of clients and presenting applications in a clear, structured, and proportionate manner. Effective preparation, sound legal understanding, and experienced advocacy are key factors in achieving a favourable outcome.

Licensing Sub-Committee hearings may involve representations from Responsible Authorities such as the Police, Licensing Enforcement, Environmental Health, and Trading Standards, as well as members of the public, including residents, residents’ associations, parish councils, or neighbouring businesses.

The Sub-Committee will determine the application having regard to:

​

  • The Licensing Act 2003

  • The local Statement of Licensing Policy

  • The licensing objectives

  • The evidence and submissions presented by all parties

​

A thorough understanding of these factors, combined with the ability to frame and present persuasive arguments, plays a vital role in the outcome of a hearing.

How We Deliver Representation

To maximise the prospects of success, we recommend instructing us as early as possible.

​

Step 1 – Case Review

Once instructed, we review the application, all correspondence with the Licensing Authority and Responsible Authorities, and any representations received.

Step 2 – Pre-Hearing Resolution

Where appropriate, we engage with Responsible Authorities and other parties in advance of the hearing to seek resolution. In many cases, representations can be withdrawn following agreement on amendments or additional safeguards. Even where full resolution is not possible, narrowing the issues in dispute is often advantageous.

Step 3 – Hearing Preparation

We work closely with the client to develop a detailed understanding of the premises, the proposed operation, and the application. We prepare and submit any required documentation and evidence and provide clear guidance to the client on the hearing process and their role.

Step 4 – Representation at the Hearing

Hearings may take place in person or remotely. Our Licensing Consultant will act as agent and will:

  • Lead the presentation of the case

  • Respond to questions from the Sub-Committee and other parties

  • Deliver a structured summing-up

Applicants are rarely required to participate extensively. Where the Sub-Committee wishes to hear directly from the applicant or the Designated Premises Supervisor, we provide guidance to ensure responses remain focused and appropriate.

Step 5 – Decision

The Licensing Sub-Committee will usually reach a decision on the day or issue a written decision, typically within five working days. The Sub-Committee may:

  • Grant the application as applied for

  • Grant the application with amendments or additional conditions

  • Refuse the application

​

Step 6 – Post-Decision Review

Where an application is granted, we review the issued Premises Licence documentation to ensure accuracy and address any anomalies.
